Anna Hazare and the anti corruption movement.


Why Anna’s movement will fail.

The Dice are loaded against the movement as the Congress party in tandem with BJP are in secret understanding to ensure that no anti-corruption measures come on the statute books.

WHY??? And HOW ???

The congress has purposely proposed this weak anti corruption law which (even with new amendments) will have a specifically weak and obnoxious clause which it will force through in the Lok Sabha knowing full well that it will fail muster in the BJP dominated Rajya Sabha-----

THUS ENSURING THAT THE BILL WILL ONCE AGAIN DIE.

All this is deep strategy as an Anti –corruption bill which is strong will obviously first hit the Congress party and its corrupt bosses and potentially expose their huge corrupt holdings etc and knowing this all too well they cannot and will not allow such a bill to become a reality.

It is not possible that the BJP does not understand this so they are obviously in cahoots either because of a threat that there own corrupt deals will be exposed or because they are being suitably rewarded.

Succession of Karmapa could impact India

The Himalayas, peopled by a large numbers Tibetan Buddhistsm, have the potential to become a belt of unease along India’s northern borders.
The Tibetan Buddhist religious orders are presently poised on the threshold of major changes, which have the potential of altering important equations settled decades ago as well as affecting the community inside China and in exile.
The momentum acquired by the international movement started by the Tibetan Buddhists under the leadership of the Dalai Lama for fulfillment of their aspirations could also be affected. Not all the changes will have an immediate impact but they could, in the course of time, have far-reaching consequences.

The impending changes relate to the Dalai Lama and consequently the leadership of all Tibetan Buddhists, and the heads of two of the major Tibetan Buddhist sects, namely the Sakya and the Karma Kargyu. Of these, the head of the Sakya sect is not a reincarnate but selected by his predecessor and his peers.
The wrangle among the four claimants for succession to the position of the XVII Gyalwa Karmapa, or head of the Karma Kargyu (or Black Hat) sub-sect of the Kargyu sect of Tibetan Buddhism, is of concern. The recent revelations of alleged illegitimate financial dealings by close aides of Ughyen Thinley Dorjee, a claimant to the position of the XVII Gyalwa Karmapa, has caused avoidable embarrassment to the office while prompting an investigation into his activities.
Ranjung Rigpi Dorjee, the XVI Gyalwa Karmapa, fled from his monastery in Tsurphu in Tibet in 1959 after the Chinese took over Tibet. He managed to bring considerable wealth belonging to the sect with him.
After becoming an exile, he travelled to the US where he established the first monastery of the Karma Kargyu sect at Woodstock. He later went to Sikkim where he set up a monastery at Rumtek, and which was designated between 1962 and 1965 as the Gyalwa Karmapa’s spiritual seat-in-exile. The Gyalwa Karmapa presides over the Karma Kargyu sub-sect with approximately 180 financially well-endowed Dharma Chakra Centres world-wide.
The Karma Kargyu is the dominant sect along the Himalayan belt, including the border regions of Sikkim and Bhutan. The sub-sect has numerous monasteries in this region. It is also in this belt that China lays claim to Indian territory. This factor, along with the internecine rivalry, is a matter of concern for India.
The succession to the throne of the XVII Gyalwa Karmapa has four claimants. Of them, Ughyen Thinley Dorjee is supported by Tai Situ Rimpoche, a regent of the sect, while the second claimant, Thaye Thinley Dorjee, has been propped up by the other surviving regent, Shamar Rimpoche.
These two frontrunners were born in Tibet, and are better known because of the influence and wealth of their patrons. Tai Situ Rimpoche, the regent who ‘discovered’ and supported Ughyen Thinley Dorjee, was successful in securing the recognition of the Dalai Lama and Beijing for his candidate. This places Ughyen Thinley Dorjee in a unique position of being the only claimant aspiring to head a Tibetan Buddhist sect who is recognised by both the Dalai Lama and Beijing.
As long as the heads of the other major Tibetan Buddhist sects and the Dalai Lama are alive, the Gyalwa Karmapa will remain only the head of one sect.
But thereafter, he could be among the very few highest ranking lamas of Tibetan Buddhism, who is formally recognised in the traditional manner, and will wield considerable influence over Buddhists. This gives his claims a definite edge over that of the other contenders, and this might make the office of the Gyalwa Karmapa more important and vulnerable to pressure and manipulation by Beijing. This vulnerability, especially sincethe incumbent’s leanings are unclear, would be a matter of serious discomfort to India.
The role and character of the inheritor to the throne of the Gyalwa Karmapa at such a time will, therefore, be crucial. All these developments could impact on India’s border negotiations with China and the maintenance of stability and calm along the vulnerable Indo-Himalayan border region, which is inhabited by a large number of followers of Tibetan Buddhism.

THIS IS HOW THE MADHESIS IN SIKKIM ARE TREATED
Don't call me bhaiya, I'm Nepali


MAHABIR PAUDYAL The other day when I was in a jam-packed public bus going to Bhaktapur, there were few madhesi people standing in the gangway. People were
being crammed into this small vessel from every stop and they were suffocating. Amidst this, I heard one of the middle-aged women, who was standing in the gangway herself, telling a madhsi man “oe bhaiya aliuta sarana (brother, will you move over a little?) in a loud discourteous tone. It looked like she was acting out the disgust function. She seemed to have this feeling of revulsion which those who have developed more refined taste and bodily controls can experience when they encounter the habits of common people. To her insolent request, he responded in Hindi accented Nepali with an unexpected display of rage. “Who do you call bhaiya, huh?” he retorted “Mind your language. Who do you think you are talking to? Do you think I am an Indian? I am as good Nepali as you. May be I am more Nepali than you are.” I could not get the full view of him for he was almost enveloped in the crowd upfront. But from what I saw of him I can gather that he was a gentleman. He had positioned two pens in the front pocket of his shirt and was possibly returning from work. The woman was no less. She asked if she was not to call him bhaiya was she to call him dhoti, a madisya (more derogatory names than bhaiya). This escalated the dispute. People at the back started making fun of the madhesi gentleman by mocking the woman’s situation. “You are provoking such person whose species is president and vice president of the country. Watch your words otherwise president and vice president won’t spare you, madam.” The madhesi man did not give in. He kept seeking explanation from her. The woman then threatened to drag him and throw him out of the bus window if he did not keep quiet. The dispute settled when some well-meaning college boys interceded on behalf of the madhesi gentleman. On the surface there is nothing very serious about this incident. The madhesi gentleman was overreacting. He could have avoided the squabble if he had chosen to acquiesce. The woman had not lashed any expletives at him, neither had she used any uncommon appellation. She had only called him bhaiya which is, in fact, a compliment. It means a brother a comrade, a common parlance of non-terai people to refer to man from the terai region. Besides, he should be used to being called bhaiya in Kathmandu for there are people here who still believe that the land beyond Thankot is India and every dark skinned man from there is Indian. In a place where more degrading names than bhaiya like madisya and dhoti are used, bhaiya should have made him happy. Two years ago, he probably would have reacted differently. But he is the representative noble product of the Terai Movement which has made him more aware and more bolder. Perhaps this is the only best thing that this movement has done to the people of terai. He has started to reassert his identity. It is the first time I heard a madhesi man reacting like this in Kathmandu. For me there is a great deal of identity and nationalism issues embedded in his reaction “am I Indian?” His is a very straightforward and unequivocal nationalism. A bhaiya for him is he who despite receiving benefits from Nepali state feels himself closer to India in terms of language, intention and attitude. A real bhaiya tolerates being called so because deep down he feels comfortable being non-Nepali. There are some prevalent notions about madhesis in the psyche of the people of hill origin; they are too clever. Even a dead madhesi can con a living Nepali. He is a crowd, noise and filth loving man and so on. This notion is, ironically, governed by class status. No madhesi man in Kathmandu will ever have to confront insults if he is rich. A madhesi with sound business and economic orientation is no more a bhaiya—he becomes a seth (rich man), a master, a huzoor (lord).Another reason for the growing distrust between a madhesi and a pahadi in recent times is the madhesi leaders themselves. They are demonizing terai people and (mis) representing them to be closer to India. Driven by their selfishness they threaten to fragment and secede Terai when they do not get shares in the government and launch movements. Therefore, the general impression of the madhesi leaders, and because of them the Madesh People, is that they want a part of or the whole of terai to be annexed into India. But this madhesi man is an example of counter reality of the terai sentiments; the madhesi people are loyal integrationist and they wish to remain Nepali. After this incident I have started to view, in new light, the standing of every madhesi vendor who is seen in the Kathmandu streets hawking for customers, announcing in Hindi accented Nepali kera, seu, angur ( banana, apple, grapes) or khali sisi purana kagaj (empty bottles, and old papers). I see him as a conscious political being in which the flame of asserting identity has been ignited no matter how depravedly his leader acts. But when in the vegetable markets I see men and women haggling over the price calling him bhaiya and madisya and when he acquiesces in, consciously or unconsciously, without uttering anything of “ Don’t call me bhaiya, I’m Nepali,” or when some wayward Kathmandu youths take apples and grapes from the fruit vendor’s basket without paying and run away threatening him instead and the police standing nearby pretend not to have seen them, I realize that it will beg some time for my thesis to take root.mbpoudyal@yahoo.com

SIKKIM POLITICS--- SIKKIM SUBJECT

Sikkim Subject :
You may bury an injustice but you can never kill an injustice.
Like Banquo’s ghost it will come back to haunt you till your death.

Today the term “Sikkim Subject” is being used to supposedly describe indigenous Sikkimese people .In fact the status is an absolute misnomer as the aforesaid “status” has been reinvented by a circuitous Sikkim government initiated ploy in 1989 to allow Nepalese of not known nationality who came to populate Sikkim after its merger with India in 1975 to become not only citizens of India but gain domicile status in the state of Sikkim.

Simultaneously the same central government directive by a sleight of hand allowed by this notification (obviously engineered by the state government) that all the old settlers of Sikkim other than Nepalese would be deprived of their constitutional right of domicile in the state as the rule allows only rural land owners to apply for Sikkim subject when the King’s laws specifically encouraged Indians to purchase land only in urban areas.

History.

The Sikkim Subject Regulations came into being in 1961 under the erstwhile King of Sikkim to stop the influx of Nepalese into his kingdom as they were posing a danger to the indigenous population. The regulations specifically allowed Sikkim subject status only to people settled in Sikkim for at least 14 years before promulgation i.e. 1961.
This law was specifically directed towards stopping Nepalese/Tibetan/Foreigners influx into Sikkim but has been construed today to deprive Indian people who have been in Sikkim for not 15 but 50 years before the act was extended in 1961.

This law also applied to all Nepalese/Tibetan immigrants and in fact even more so as they were also governed by the “Sikkim Work Permit Regulations” (till date in effect ) which further required that on entry into Sikkim they must be listed (unless they were Indians) and they were specifically were barred from any property rights in Sikkim.

Thus any entrants to Sikkim before 1974 must either be Indians or if they were stateless then they should have been registered under the work permit rules and there should be a record with the government of these people, and they alone if any, are entitled to Domicile status. All others must be considered as Foreigners without any rights.

In addition all Indians were protected by the 1950 Treaty of Peace and Friendship between Sikkim and India. The treaty specifically recognized the reciprocal rights of Sikkimese and Indians to settle in, own property and engage in commerce in each others territory without any let or hindrance.
The treaty specifically granted to Indian Citizens all the rights of citizenship under the Sikkimese Government and the 1961 regulations acknowledged this fact by not requiring Indians to apply for the aforesaid “Subject Status” to avail of any protection under Sikkim’s laws as absolutely equal citizens.
In fact the Indian community as a whole were treated absoloutely equally by the ruler and his administration without any discrimination whatsoever vis-à-vis the indigenous people. After the ruler was deposed in 1975 both “Padma Vibhushan Kazi” and “N.B. Bhandari” administrations continued the equal treatment and in fact even the current administration more or less continued the same policies till the passing of the Finance Act 2008 when Mr.Chidambaran was inveigled into pronouncing on the term “Sikkimese” in the Union Budget.

This opened a “Pandora’s box” and the “Chamling” government quickly started expanding on the term (Sikkimese and “Sikkim Subject”) to deprive a communally sensitive minority of their rights in a blatant attempt to try and foist an ethnically Nepalese state on the Indian union. (The indigenous people are a fast reducing minority who will like the Parsees soon face extinction and all the other communities have been deprived of Domicile status by a spate of bills in the Sikkim Assembly which even deprive them of Basic Human rights.)

Thus all others in spite of living in Sikkim for more than a hundred years are now not “Sikkim Subjects” ------all state protection and avenues of advancement are barred to them. (No hospital treatment/no educational benefits/no trade licenses/ no part in any state sponsored activity.)

In actual fact the Nepalese of unknown status(stateless according to petition of the “Bhandari” government in the petitions committee of Rajya Sabha) were granted both Indian citizenship and by a convoluted operative portion of the directive also became “Sikkim Subject’s” although “Sikkim Subject status” was specifically repealed by the Central Government when Sikkim joined the Indian Union .There cannot legally be any recognition of any status beyond “Indian Citizen” or “State Domicile” as these are the only two recognized status for a citizen of India.

However cleverly the above ‘Sikkimese” status pronounced by Mr. Chidamabaran is now being used as a logic to bestow citizenship (central government’s prerogative) in the state of Sikkim. The “Chamling” Government has in effect allowed Stateless persons to acquire a status above the actual Domiciled people of the state—a special citizenship granted by the state government. Any special status for foreigner’s would certainly in years to come translate into a fertile ground for anti –India forces to claim and proclaim sovereignty and other such mischievous claims in Sikkim.

Conclusion.

The fate of Jammu after Prime Minister Pandit Nehru’s tribe were thrown out and where today no Indians are left to protect or project India’s claims will surely descend on Sikkim too.

The constitutional anarchy attempted by the ‘Chamling” government in trying to foist a Nepalese population as absolute rulers on the minority indigenous Sikkimese and their natural allies “The Old Sikkimese of other than Nepalese origins” must and will result in the fall of the government for unconstitutional practices as soon as the central government or the Supreme court applies its mind to the subject as at the least basic protection under Articles 14 and 15 of the Constitution of India have been blatantly flouted.

History of Sikkim Subject status in Sikkim(Corrected

History.

THE CENTRAL GOVERNMENT HAD PROPOSED (BY THE RECENT AMENDENT TO THE FINANCE ACT2008, )TO MAKE INCOME TAX PAYABLE IN SIKKIM BY ALL THOSE WITHOUT SIKKIM SUBJECT STATUS----- IGNORING THE FOUNDAMENTAL RIGHTS OF ALL THOSE LIVING IN SIKKIM FOR GENERATIONS , WHO HAVE NOT BEEN GRANTED THE SAID SIKKIM SUBJECT STATUS BECAUSE OF RACIAL DESCRIMINATION .


What is this Sikkim subject qualification?

This was originally the list of people who the erstwhile Chogyal recognized for the purpose of protecting his vote bank in the erstwhile kingdom. This list was promulgated and maintained for the purpose of keeping the voting restricted in a manner to help keep the Bhutia /Lepcha community, to which the Chogyal belonged, in absolute power.

This was imperative for the ruler in the face of ever increasing Nepalese immigration from both Nepal and Darjeeling district. In infact the Bhutia/Lepcha votes were given extra numerical value to ensure that the erstwhile National Party promoted by the Chogyal retained ethnic power.

After democracy was introduced in Sikkim the first Chief Minister lasted a single term and in the second election Nar Bahadur Bhandari seized power by engineering defections from the " Rising sun " party of Shri Ram Chandra Poudyal a hero of the struggle against the Choyal's unpopular regime.

As a consequence the Nepalese tasted power for the first time in Sikkim but soon realized to their dismay that they could never enjoy the true fruits political power as the Bhutia/ Lepcha community controlled (12 out of 32) assembly seats reserved for them as per the terms of the merger.

To undo this promise of the government of India a movement headed by N.B.Bhandari the Chief Minister headed for New Delhi to persuade the Central Government to give a one time waiver and include 80,000 Nepalese in the "Sikkim Subject" Register. This was a very selective list of people from only one community (NEPALESE) and was prepared specifically for the purpose of retaining and ensuring political power for this community.

No other communities were included in this list which was based solely on racial considerations.There were in actual fact many other people from other communities like Bihari, Punjabi, Marwari, Muslim and many more including some Congress Party Nationalist Nepalese of Darjeeling origin who met all and more of the required criteria and who were specifically not included .
All the above groups were perceived at that time by the Nepalese leadership to be a vote bloc which would

1. Vote against any anti-India legislation introduced in the Assembly.( Then C.M. N.B.Bhandari espoused an Anti India campaign with his "Return Sikkim to the King " platform .and under which he campaigned in the elections against L.D.Kazi the supreme leader of the Revolution against the Choyal's autocratic rule) and
2. Vote with the ethnic Bhutia/Lepcha community and add to their numbers in any situation to help prevent any brute Nepali majority from smothering legitimate minority aspirations.

The Second Bhandari electoral victory around 83/84 saw him come to power with a brute majority commanding 31 out of 32 MLA's in the Assembly. However, this victory was soured by the single opposition winner from the prestigious Gangtok constituency from where Balchand Sarda of Marwari decent fought and won as an Independent candidate against a very strong Mrs.Bhandari the wife of the winning chief minister.

Ironically the advisors of L.D.Kazi the ruling Chief Minister had felt that fielding Balchand would disturb Nepali sentiment and put all other seats at risk because of Nepali ire at such a move and had strongly advocated against giving Balchand party backing.

This victory of Balchand galvanized Bhandari to try to pressurize the centre to allow citizenship to the aforesaid eighty thousand odd Nepalese but Mrs.Gandhi shrewdly realizing intentions of Bhandari refused the request outright. However in time V.P.SINGH became the Prime Minister and Bhandari quickly managed to diametrically turn Delhi’s views.

As a consequence the family of this Balchand Sarda with a hundred years of history in Sikkim , even elected as MLA in Sikkim is now being deprived of Sikkimese identity and being discriminated against while people of very recent entry into Sikkim from Nepal etc are being given this benefit of this recognition with attendant benefits in employment and Tax concessions.

However in actual fact in the ensuing years the granting of "Sikkim subject status" to individual candidates continued unabated and continues till date and has been awarded to many applicants from both the Bhutia /Lepcha and Nepali communities who have migrated from either Nepal or Darjeeling District. Most of these successful applicants are of very doubtful antecedents and historical veracity. (Depending on which party was in power at the time "subject status" applications of various people of different ethnic backgrounds have succeeded. Thus when a Bhutia friendly administration reigned even Tibetan Refugees have been granted the coveted "status" in the bid to increase their numbers and vice versa when Nepali friendly administration is in power all sorts of recent entrants to Sikkim from Nepal etc have been granted this status. )

The minority communities not having political protection and living in an atmosphere of a heavy communal divide have continuously been decimated and discriminated against as a group -----irrespective of their history in Sikkim or contribution to the state.

This policy of blatant communalism is further expounded by the recent bill in the Sikkim assembly proposing to enact a law by which all jobs in the state of Sikkim whether in the private or public sector are to be reserved for "Sikkimese" i.e. "Sikkim Subject Holders" which means that now even children of people of Sikkim who have been residing in Sikkim for over a hundred years are not eligible for jobs even in the private sector in the state – and this discrimination continues to date even after 34 years of joining the Indian Union.)

Similarly the state has a very aggressive policy of barring even petty business ventures in Sikkim by requiring impossible conditions from “Indians” for even petty business trade licenses from the municipal authorities. To add insult to injury the erstwhile Municipal Corporation has been superseded, and not reinstated for more than 22 years, so people of Indian origin (who are mostly conglomerated around towns) have no say in the democratic functioning of the state and are deprived of a voice in the one place that their voice might count.


In Fact all sorts of constitutional immoralities have been committed in this state and it is time that the central authorities established the rule of the constitution as envisaged by the founding fathers or we will see the exact recreation of the saga of the persecution of Kashmiri Pundits in Jammu happening to the “Indians” in Sikkim.

GORKHALAND MUSINGS


I came across a small booklet released by Dr.Wangyal in support of Gorkhaland entitled “Brief notes on Gorkhaland “.
The larger part is related to the factual narration of the history of Darjeeling and the history of Nepali influx into Darjeeling with the stated aim of proving them to be original inhabitants (contradiction in itself as if they came in --- whenever --–they are not ethnic but immigrants---- both Marwari and Nepalese.)
A large portion lists the many memorandums etc to the various authorities for the grant of an exclusive Nepali homeland.
Dr. Wangyal vigorously refutes three opposing viewpoints, (taken from the internet) with both gusto and passion but with little substance.
For a self acclaimed intellectual he certainly takes umbrage very easily and takes all opposition very personally . He promptly categorizes opposition as non-Historian or non-economist or non-local and so unworthy and without locus -standi to comment !!
For somebody who proclaims “WRITING REJOINDERS IS NOT MY CUP OF TEA” he has sent rejoinders to three people in the booklet.
Produced below as an example is his reply to one P.C. Mundhra's letter and the good doctor plays a lot of "gulchay" (in the doctors own use of the vernacular.)
Format used is First Mundhra's views (Paranoid Mundhra) then Doctor Wangyal's reply (Gulchay Doctor ) and finally my comments.

“PARANOID MUNDHRA."
The Nepalese have immigrated to Darjeeling (Sikkim) area, at best within just the last hundred and fifty years, and are, (leaving aside the Bangladeshi's), the most recent substantial immigrants into India. Today the chicken's neck is in dire threat of going under the control of these two groups, (until very recently the vast majority were of foreign citizenry), because of the folly of vote bank politics which has allowed and encouraged them to freely populate this area.
Even today more than 50% of the Nepalese residents are immigrants who have entered India after 1950 which fact legally bars them from Indian citizenship as per the provisions of the Indo-Nepal Treaty of 1950—- and as for the Bangladeshi's we all know where they come from ,in what numbers they enter India , and where their faith and beliefs lie. (Subba an alleged murderer from Nepal is now a member of parliament in India!)
In addition both these citizen groups enjoy the benefit of going back to their country of origin as and when they want to, to the welcoming arms of their respective governments who grant them instant citizenship. (In fact Nepalese law expressly provides that a Nepalese person may return at any time and claim citizenship. And of-course both these governments openly harbour anti-Indian forces on their soil and look on with fierce favour at these forces collaborating with India's enemies from Bangladesh and Pakistan through their surrogate separatist fronts in Assam and Coochbihar. (Ironically these very same outfits, till very recently, when they comprehended the mischief potential from this group, accused the Nepalese of being Foreigners!!)
"GULCHAY DOCTOR."
1. A lot has been said about certain people being 'immigrants' and for P.C. to single out the Nepalis as immigrants amounts to 'The pot calling the kettle black'. After all P.C. timro babu-bajay pani ta Rajeshthan bata Sikkim paseko immigrants thiyo ani aaja pani tapaiharu immigranta nai ho. Or were your ancestors there in Sikkim when Phuntshog Namgyal became the first Chhogyal. Satya kura yo ho…Sikkim ko sabhai Marwari haru including the Mundras, Bhojraaj, Lakhotias, Sardas, Agarwals etc. etc. etc are also immigrants. You have mentioned of the Nepalis "until very recently the vast majority were of foreign citizenry" but you probably don't realize how many times the Marwaris appealed to the Sikkim Maharaja to make them SIKKIM SUBJECTS when Sikkim was not a part of India. This amounts to dumping one's Indian citizenship for that of Sikkim's and with that in reference how can you cast aspersions on another community's loyalty! Gilasko gharma basney harulay aruko gharma dhunga hirkaunu hundaina.
COMMENT.
Accusation of Marwari's also being immigrants does not absolve the Nepalese from being immigrants .In fact it actually reinforces the position. At best both communities are immigrants and after Sikkim became a part of India all became Indians except if they held any other nationality. However, a Nepalese residing in India before 1950 was given special rights to acquire Indian citizenship by the 1950 treaty between two countries and similarly an orginal East Pakistani refugee was also given privileges.
As long as the king ruled in Sikkim --- the plains origin people in Sikkim were treated as immigrants along with the vast majority of Nepalese in Sikkim who mostly came from Nepal .So both had equal negative status.
3. Dr. Wangyal is simply wrong to allege that the plainspeople petitioned the king for Sikkim citizenship. In fact "Indians" as they were known were not allowed to apply for citizenship and were not given citizenship except as an exceptional favour by royal decree. Anyway how does Nepalese forsaking Nepalese citizenship translate to loyalty and Marwari's doing ditto with Indian citizenship "disloyalty"?
4. Equating the Marwari's love for accumulating money through business (good and bad practices) as similar to the Nepalese love for money through mercenary soldering (atrocity or legitimate battle) certainly does not do credit to the latter in a comparison.

The Gorkhas, famous in battle, have always proved deadly enemies, whether in ruthlessly exterminating freedom fighters on behalf of the British in Jalianwala Bagh or in maintaining British imperialism on Argentinean soil. They have an equally well deserved reputation for putting moral concerns of right and wrong completely aside when delivering services for contracted payment—- very often even with their lives.
In fact they also have more than an equal reputation for single minded tenacity and foolhardy courage in pursuit of ensuring blood payment against their monetary obligations. They are in short the perfect mercenary breed.

A strong mention has been made that the Gorkhas would do almost anything, even to the extent of losing their lives, for the sake of a buck or two…isn't that what exactly P.C.'s glorified 'traders' have always done, are doing and will do, and that includes you too, P.C. bhaiji. Exceptions do occur and it will be a rare event to see a trader leave his green pastures for a lesser lucrative area to express solidarity to his community, district, state or nation in problems. The best perfume, to have and to flaunt, to a trader has always been money, money and more money. The more the merrier. Three cheers to the banks and three, much louder, cheers to the black economy.
COMMENT.
Three cheers indeed and where is the negative in this. I assume that a trader's contribution is to make money for the economy and this is welcome especially when he does do this without sacrificing precious life. How does this become a negative?
More to the point how does it compare to the foolhardy nature of losing your own life for petty money after leaving your home and hearth and nation.
One uses brains the other brawn ----- but both for money. Obviously neither Gorkha soldier nor Marwari trader would leave home for a less lucrative arena. Both go for money and that is the only valid comparison here. At best again both are traders.
The Rajput and Gorkha are both great soldiers as the Newars and Marwaris are great businessmen with positive or negative connotations, as they deserve.

Today, they form a forced majority in the Darjeeling hills, and conspire by threat and sheer force to actually constitute a state that compromises India's strategic chicken neck corridor. (In which specific area, ironically they do not actually constitute even a remote majority and the inclusion of which actually deprives the proposed Nepalese State of its very political basis)
So why would they fight for a state where they might be in a minority and who would plan and pay for such a scenario.
Things might become substantially clearer when you apply the likely proviso , that the Bangladeshi element of the population in these plain areas could in conjunction with this hill population decisively out vote the actual inhabitants or Bhumiputras of this region .(Note that there is a pre-independence history of an attempt in both Darjeeling and Islampur to secede to East Pakistan .)
How are immigrants demanding a state?

And in this case let me just tell you about the REAL exception: an absolutely exceptionally exceptional event. Just before our independence the Gorkha Regiments were divided between Britain (2nd, 6th, 7th and 10th Regiments) and India (the rest up to the 10th Gorkhas, the eleventh being a post independence event). The cocksure British wanted to drive home the point that they had been good masters and in an effort to prove it they announced that any of the Gorkhas transferred to the British Regiments (2nd, 6th, 7th and 10th Gorkhas) could voluntarily leave it in favour of the Indian Gorkhas. To the surprise, shock and dismay of the British 90% of the Gorkhas opted to serve under the Indian Gorkhas despite the better salaries, cushy living standards, better food and health care, and fatter pension under the British. (Col. C.L. Proudfoot: Flash of the Khukri, Vision Books, New Delhi, 1984, p. 27) How many traders (cultural ambassadors, did you say!) turn their noses against the smell of crisp sterling pounds in favour or the rupee which is eighty times less the value in the market. But the story has a tail that wags to the discomfort of people like PC. Col. Khanduri recalls that the Gorkhas "were officered exclusively by high grade British officers and the process of 'Indianization' was not allowed to seep in…" (Chandra B. Khanduri: A Re-constructed History of Gorkhas, Gyan Sagar Publication, Delhi, 1992, p. 280) and even then the Gorkhas opted to serve under the Indian Gorkhas. Need anything more be said! Ah! Yes, Khanduri is a Garhwali whose ancestors had been conquered and slain by the Gorkha khukuri during the Nepali expansion under Prithvinarayan Shah and his sons. Khanduri, like a true historian, does not scratch the old wound to make it bleed again.
COMMENT.
Of-course they would opt for India, as it was the better bargain. It was closer to home and India required a bigger numbers of recruits. India offered security of identity and citizenship while the British would pay their servants well, but they would never be awarded equal Status with the British. Similarly Ranks and promotion were restricted in the British army for the mercenary outsider and after service tenure was completed he had to return to Nepal/India. So India was simply the better choice. Also the British atrocities in India by then had created a general revulsion toward that race --- so much so that an army under Netaji with Indian Gorkhas also in tow was fighting against the British.
People are confusing legitimate Indian Gorkhas with the non-Indian immigrants who have obviously to be verified for their integrity along with similar Bangladeshi immigrants to ensure that they are not inimical to Indian interests.

In such a scenario, (with the well established proclivity of the Nepalese in the hills to blackmail the ordinary citizen and weak governments into acceding to their every whim by frequent and long bandhs) they could demand any price from an enemy state to rustle up trouble in the new state.
Remember Ghising frequently called bandhs, even for 40 days and he did this every time the tourist season came around so that the suffering of the ordinary people in the plains or in Sikkim could be made to bear on the inevitable government reaction.
This success only made the blackmailers bolder every time they succeeded in getting their impossible and even illegal demands accepted.
Finally ,to their utter astonishment ,when even the illegal 6th schedule constitutional amendment was conceded, it dawned on them that this weak and corrupt governments would knuckle down to every demand right or wrong and so the bold new demand for a state with Siliguri in tow to cut India in two.

Jalianwala Bagh is an unfortunate incident. The Gorkhas just happened to be the right people at the right time for the wrong purpose. 'Right people' because the strongest and therefore the most valued quality in a soldier is to obey a command, even if it means to charge 'into the valley of death' and the Gorkhas would obey any command ( Hukumko jawab chhaina). 'Right time' because it so happened that the Gorkha were garrisoned at that place else it could have been the Sikhs, Marathas, Rajputs etc
COMMENT.
Mundhra's comment about Ghising is unfortunate as portraying a mad man as a representative of a community is unfair. However, obeying illegal commands (British or Ghising ) or putting India's security at stake or making illegal political demands without any sense of constitutional regard or propriety is not what a true Indian would be expected to support.
"Right people" for obeying such terrible orders? Why.
"Right time "? To crush the Indian freedom movement ?
I think the doctor will find from his own quoted sources that the British choice of solders was very specific and not by chance . General Dyer specifically discarded other available solders, as it was perceived that they would surely revolt against such a murderous command.
And doctor where is the honour in obeying an order to shoot helpless children and women to the extent that they were forced by the sheer barbarity of the soldiers to throw themselves into a well where they drowned.
Comparing forcing children to charge into wells in fear to solders with "charging into the valley of death" is going a bit to far. Talk about below the belt arguments.
Doctor declares “nothing more needs to be said about soldering of this kind"
Really should we say nothing about obeying an illegal command to commit murder and for which even the British themselves punished Dyer?? Perhaps the Punjab government should put a stop to the planned observation of the centenary of the ghastly event.
It is difficult for Indians in general to forget and Sikhs in particular not to remember this event? Of course the Sikhs would not have obeyed such an order nor would the Gorkhas against helpless Nepalese women and children.

The opposition meanwhile is only too well aware that it has the communists by the hip and true to Gorkha characteristics will press for the kill mercilessly.
This division has the potential to separate the Indian republic from the seven eastern states exactly as Pakistan was rent apart from Bangladesh.

In this regard one must venture back into Indian history and there we find that the British always used the Indian sepoys (sipahi) for the expansion of the British empire. It was the sipahi from a conquered Indian kingdom that was used to conquer another Indian kingdom and from this conquered kingdom more sipahis were recruited to conquer another Indian kingdom or principality. Without the assistance of the Indian sipahis even Clive would have lost Plassey and we would have been spared the drudgery of learning our history punctuated by Governor-Generals, Viceroys, Sirs, Lords, and all that crap. Just prior to the Sepoy Mutiny/Revolt Indian sipahis were used to conquer Punjab . When the sipahi mutiny broke out the British used the Sikhs, who had an axe to grind, to quell the rebellion. Now to whom do we point the accusing index finger to? The Indian sipahis, the Sikhs or the British (the latter didn't care a hoot, anyway, as to who killed whom as long as the job was done). Each of this must be remembered for its tragic consequences but not as a point of argument to pit one against another. Jalianwala Bagh massacre has been fortunately remembered, re-written and recalled by historians for its gross tragedy and its aftermath but not necessarily because the Afghans and Gorkhas pulled the trigger. But P.C. is not a historian, not even by the most generous of concessions, and so he will delight at punching home the point for, unfortunately, the wrong reasons.
COMMENT
History must be remembered not for its tragic consequences but to ensure the mistakes are not repeated to repeat past blunders. (Debacle of Pakistan in Bangladesh or killing of innocents in Jallianwalla Bagh.)
Solder against solder in battle and solder for murdering unarmed and helpless children and women are surely different or am I missing a point.
P.C. is certainly not the Historian but the good Doctor does claim the nomenclature and he will agree that Jallianwalla Bagh is remembered because it was different from all his examples of legitimate battles between soldiers----- and there lies the rub and the difference between atrocity and tragedy.
Methinks even the British punished Dyer for his atrocity and not because of any tragedy associated with the horrendous massacre.

Little do the Paper Nepalese Tigers in Sikkim and Darjeeling realize that people like Tiger Bal Thackeray and the North Eastern states like Meghalaya are watching their every move with rapt attention .Should these (RESERVATIONS FOR MAJORITY COMMUNITY )law pass Judicial scrutiny all these governments would quickly pass similar laws and over one Crore Nepalese from Maharashtra alone would be at the receiving end of a law which would have been promoted by their very own Nepalese champions.
Earlier a similar situation in Shillong when the Nepalese were specifically thrown out of the state required much tact, deft handling and effort on the part of the central government to restore the status quo ante. Were such a law to pass in Sikkim they would be one more reciprocal mass Exodus of Nepalese from the North East and they would all flock to Sikkim and Darjeeling.
This area has already seen a huge influx because of the refugees from Bhutan and another influx would create many social tensions in the foothills which would certainly bode ill for the interests of the Government of India.
Of-course the supreme irony of any such law would be that a Nepalese would be responsible for implementing a law that the Nepalese have historically been fighting against literally in every corner of the world that this community has migrated to in search of employment hearth and home.
"GULCHAY DOCTOR."
There are several places where Mundra hits below the belt. (Kina gulchay kheleko!) Where an issue is so encompassing as DARJEELING-–BIMAL GURUNG–SIKKIM–CHAMLING–KOLKATA– DELHI one should not let personal animosity to be one of the operating drive to move an argument.
COMMENT
Mundhra's figures are from his imagination. The total population of Nepalese in India is not more than 30 Lacs and only half of these are in the Darjeeling area. Where does this "One Crore" Nepalese total come from? However Doctor with his obvious animosity towards Marwari's and traders can hardly comment as it would be like the pot calling the kettle black.

Instead an impotent central government and its corrupt bureaucracy shares in the institutionalized corruption of Chief Ministers like Pawan Kumar Chamling who is openly pumping in money into this separatist movement.
Chamling has been successfully postponing a well documented corruption case in the Supreme Court and Officers of the Central Government are openly helping him in this exercise. Now the same central governments will send in army and paramilitary forces to die fighting in these same hills pitted against the money and forces provided by this same Chamling under the guise of promoting singers etc.
A classic case of the right hand and the left hand of the same body destroying each other in full public view.
Were this case of misappropriated assets followed up vigorously, one of the main source of finance could at least be stopped from becoming a tool in the hands of India's enemies. Instead Chamling is successfully diverting the attention of the people by pretending to fight a another Nepalese cause so that he can claim political dividends at India's cost and simultaneously he also aims to scare the Judiciary from proceeding against him by projecting a national emergency in the region .

About Chamling amassing ill-gotten wealth, the last word is yet to be said. Till the courts pronounces the verdict any attempt to buttress one's line of reasoning using a pending suit amounts to deception. I could very well file a suit saying P.C. Mundra is an alien and should someone else use the litigation to structure his argument that whatever P.C. is writing is in the interest of aliens would not do fairness to reasonable assertion. The same goes for Mani Kumar Subba's nationality and his supposed guilt of murder. Using unproven matters as proofs takes away any credibility that P.C. might have achieved earlier.
COMMENT
But both these matters are matters that have been discussed in the Supreme Court of India and the Indian Parliament and in the print and televised media. It is even acknowledged in televised sting operations where both parties have spoken in the public domain.
And yet because it is inconvenient the doctor would not allow mention? It is now being said in the public domain that Chamling even holds Nepalese citizenship and so has dual nationality!

There is no dearth of Chinese and Pakistani agents in the garb of monsters, monks, mullahs and monastery's ready to inundate this area with any amount of money to destabilize India.

A lot of generalizations have been resorted to and any student of debate and logic knows that generalization is one of the biggest and deepest pitfalls in a discussion. Take for example the Jains. Almost all the major financial scams in India were the handiwork of one Jain or the other. Nevertheless, a public debater will invariably and instinctively distance himself a long way off in generalizing that all Jains are scamsters…he would be wary of even saying 'most Jains are scamsters'. Don't let personal dislike cloud your argument and don't generalize to argue a specific point.
COMMENT
How can you bring in a new generalization into an argument yourself and then claim that one should not use a generalization to buttress an argument. Where is the generalization in separating Indian Nepalese from others just as foreign Indians of any tribe are different from their Indian counterparts.
Generalizations about Chinese or Pakistani intent are absolutely in order in view of past experiences.
Specific mention of Chamling not allowed! General mention of Gorkhas not allowed! But the generalization about the Marwari trader and money made earlier on is fair?
Did somebody talk about logic in debate?

In fact a chauvinistic Chamling cares little for Indian concerns or the Indian constitution .He recently used his brute majority in the Sikkim assembly to pass a patently illegal act reserving 95% of the jobs in the state .The Governor returned the bill as patently unconstitutional and promptly in defiance of even the Governor's constitutional office Chamling re passed another similar Act, again an illegal bill, this time reserving 80% of the jobs for the majority community.!
It is truly amazing that the Sikkimese Nepalese have forgotten so quickly the discrimination that they suffered for decades under the erstwhile ruler and now actually seek to impose similar discriminatory laws on others in the state.
Supposedly in fulfillment of an apocryphal prophecy the betrayal of the king of Sikkim by the Nepalese apparently forewarned the king of Bhutan. He than supposedly took preventive action and the Government of India also realizing their earlier folly in Sikkim helped the Bhutanese monarch to save both his people and larger Indian interests.

Anyway, there is a point where I find a convergence of view with Mundra. 80% reservation of jobs for a single community is wrong. It will invite judicial enquiry, if it hasn't already. On this matter I P.C. my best wishes.

Yes indeed Doctor you would need to support this because if Bimal Gurung lets out that he plans exactly the same fate for the minority communities that Chamling aims at in Sikkim --Nobody just Nobody from the Doars or the Tibetans or the Bihari's or the Marwari's of Mundhra's tribe or the Bhutia's of Doctors tribe would join the Gorkhaland brigade. The concept would be restricted to the hills where a total of a ridiculous 14 Lacs Nepalese would be demanding a Gorkha state in a huge area which encompasses more non-Gorkhas than Gorkhas.

Simultaneously and shamefully the same rights that Indians doled out without a thought to Nepalese in India, Indians in Nepal , living there for generations, were and are systematically denied —-and our impotent representatives in the Indian Embassy have actually turned their back every time that an insult or injury has been hurled at the Indians in that country.
Any self respecting government would rush to the help of their citizenry. We have seen both British and U.S. government's fight tenaciously for even criminal citizens like Peter Bleach who they have ultimately even repatriated.
The Indian foreign service bred on Nehruian contempt for the trading class has still not realized that the van guard for any propagation of Indian culture, thought ,values and views in any area of the world can only succeed when the Indian trading class in that country succeeds and not because of any supposed promotional efforts of the embassies or government departments.( Today the business community in USA and U.K. for example do much more to promote Indian political interests than any government effort etc)
Unfortunately our foreign service has always held our trading class in contempt and our diplomats would not normally been seen dead in their company in the various countries where they are posted. In fact they treat them as pariahs and actually propagate that Gandhi's tribe are not true representatives of India and Indian ness.
So true to form, a weak central government actually allowed, under Nar Bahadur Bhandari's pressure, 80,000 Nepalese immigrants "citizenship rights" overnight. Under Chamling these very same immigrants now support the separatist movement. Simultaneously the same central government deprives Indian citizens of fiscal benefits, freely given to these recent immigrants, even though the deprived Indians are older residents and have contributed and sacrificed much much more for this region and its development.
Epilogue.
The Madheses of southern Nepal fed up with the age old discrimination and bias of the Nepalese in the North have decided on and are near succeeding in an armed struggle to carve Nepal into two halves.
North : Nepalese.
South : Indian Madesh.

Nepalese scene latest

1.As predicted in the earlier article Prachanda is going ahead against the Madhesi population and is getting ready to bully the Indian Government into sacrificing the Madhesi interests in return for access to Nepalese agreeing to tow the Indian line----but for how long --the Indian government will never learn that this never ending blackmail of Nepal will never stop and more important Nepalese Goverments will never learn that this will ultimately destroy the concept of Nepal which is what Indian security interests are aiming for and slowly accomplishing a la Pakistan/Bangladesh/Sri Lanka.

MADHESI ISSUE AS A CAUSE OF FUTURE SOCIAL CONFLICT IN SIKKIM

After the end of World Wars, there has been exponential increase inintra state wars and conflicts. Such conflicts are results ofaccumulation of various inter-wined factors of social psychology, andhence, the exact cause of such conflict cannot be pin-pointed.However, it can be argued that there always exists a real or perceiveddiscrimination component in any genuine conflict.The magnitude of conflict is directly proportional to the magnitude ofemotional attachment to the issue, multiplied by the perceived degreeof discrimination by the warring groups regarding distribution ofeconomic, political, social and other resources. When measured on thecontinuum of magnitude and graveness, it is 'Deep-Rooted' conflictthat takes the first position.Deep rooted conflicts originate largely within states (unlike interstate wars), and combine two powerful elements: identity-based factorsthat are emotionally charged and the sense of injustice anddiscrimination. Identity factors are based on differences in race,religion, culture, language etc. Among these two, the identity crisishas much more to contribute in magnitude and persistence of theconflict. Out of twenty seven major armed conflicts (greater than onethousand deaths per year) in 1996, twenty two had a clear identitycomponent in them. Complexity, persistency and intractability are thebasic characteristics of deep-rooted conflictsThe intra state conflicts in Sri Lanka, Bangladesh, pre 70s muslimsconflict in India, Bosnia, former Yugoslavia, Rwanda, Afghanistan, etcare the examples of deep rooted conflicts. Thee conflicts are complexin nature which doesn't have a simple quick-fix formula to solution.Moreover, the foreign and regional powers' interests on stability ofthe country give quite fierce and unpredictable shape to it. Most ofthe intra state conflict have spilled to become inter state cold warsor even full fledged.Let us ponder over some home issues related to conflict:

Is Madhesi issue of Nepal going to bring in deep rooted conflict?

Are our leadersfaking to be ignorant about the graveness and further provoking suchconflict? Is the media responsible?The Madhesi issue is a deep-rooted issue. The practice of state'sfavourism for the ethnic groups of pahad/hill/mountain and itsdiscrimination towards those who are non-pahadis has brought aboutthis crisis. The state's age old practice of discrimination has beengiven continuity by the current democratic governments, politicalparties and media, all of them headed by those belonging to thefavoured lot. Due to this, Madhesis cannot compete fairly with therest. They feel no sense of equality. Only those Madhesis who havehidden or maneuvered their identity have been able to get into stateorgans though with frowned dignity. Otherwise, all the remaining is atloss of their identical dignity and hence there is a clear identitycrisis.Recently, the leaders of big political parties who claim to be ofnational stature, feel that the reason the Madhesis have demanded afederal autonomous state is to disintegrate the country. By suchstatements, it is clear that they are unable to see the Madhesicrisis. It is because they are still using their old lenses and nevercared to borrow a Madhesi lens. Therefore, they are puzzled as to whythis issue has caught up velocity in very short time (two or threeyears). I would like to remind such people of the ethnic conflict informer Yugoslavia in 1990 where the conflict was suppressed for fiftyyears and was presumed that everything was fine, normal and undercontrol. However, the Eastern Bloc failed to notice that the emotionalconflict was always there and unresolved. This led to manifestation ofhuge conflict after fifty years!The so called 'national' parties have a myopic vision and are livingin a hallucinatory and imaginative world. They think that they are theones who have been given responsibility of guarding the sovereignty ofthe country, and all 'others' are squatters who have settled therewith intention to disintegrate their personal property. This attitudewill never let them understand the madhesi crisis and their reflexwill always find ways to alienate them. For example, the CommunistParty of Nepal (UML) including other non-madhes based parties areactively trying to prove that this issue is artificial and isprovoking some quarters of madhesis to get disassociated with themadhesis' demands. May be they fear to share the pie which they hadbeen relishing alone since inception. By labeling this genuine crisisas artificial and trying to dilute it by promoting the practice of'divide and rule', the state leaders might be close to a short termpain relief, but certainly far from finding permanent cure to theproblem.Suppression can never be a solution to any deep-rooted crisis. Theconflict in Nepal is bound to be grave because the Madhesis take thisas a fight for personal and social dignity and equality and hence,have associated emotional component. On the other side, thediscriminatory practice has been ever growing and institutionalizedinto the culture and lifestyle of almost all the remaining population– the 'Non-Madhesis' of Nepal.The negotiators are always tempted to go by the short stability thanto search a long term sustainability to diffuse the conflict. Theshort term approaches are good to save immediate loss of lives andresources but do not guarantee permanent peace. It is also astatistical fact that most of such short term cures have failed withinfive years of settlement. The negotiators should not be tempted topush for superficial success to reach to any agreement for the sake ofreaching an agreement. It is the quality that is important in suchagreements. Long term stability should not be sacrificed for shortterm expediency.The recent conflict of Maoist Vs State in Nepal was also instigated bythe state's attitude of discrimination. However this discriminationwas in distribution of economic resources. There was less of emotionalcomponent involved and was a logical and simple conflict ofredistribution of resources among all. Now, the conflict is nearly toits logical end in a short span of time, with relatively less loss oflives and resources. The state should learn some lesson from this. Ifthe madhes issue is left uncared then there is a strong possibility ofa new conflict that is bound to be a long lasting, multi-decadestruggle. The new struggle will be proportional in magnitude to thedegree of reluctance of the state to involve the madhesis in powersharing and stop unchecked ethnic discrimination.
Until the negotiating parties do not become sensitive to thegrievances of each other, and genuinely try to find an amicable andsustainable solution, the negotiation doesn't bring any lastingsolution. If negotiation fails, some conflict experts have claimedthat mass expulsion or genocide are the only ways that will make deep-rooted conflicts disappear. In identity based conflicts, partitionbecomes the only way out to further stop the violence, once conflictstarts. Is the country prepared for this path?In deep rooted conflicts, due to the involvement of factors likeidentity, dignity and ego, sustainable solution becomes really hard tofind. Sometimes even the basic democratic process like the rule ofmajority in decision making or even referendum or other democraticprocess that gives verdict in 'yes' or 'no' have negative effects andis detrimental in the settlement process. Therefore, basic democraticvalues as pluralism, tolerance, inclusiveness, negotiation andcompromise must be practiced with perseverance to reach to a solutionthat is based on the spirit of justice and equality like powersharing, autonomy and proportionality. In Angolan conflict, the loserparty of political transition resumed fighting. They judged it as abetter option as that would give them another chance to accomplishtheir deep-rooted objectives, than to stay in the political process ina powerless position.The Moaists who are forming the new government has much moreresponsibility than their predecessors because they are the hope andexpectation of the marginalized groups. The madhesis do not wantconflict, but if similar discrimination is practiced and tactics likedivide and rule is continued by the state or other stakeholders, it isbut the states invitation to conflict. The government has already lostits sincerity by making a mock of the agreements with madhesis twice.It will be impossible for the government to control the situation if athird round of struggle comes in. It is but an inevitable event unlessthe government, media and society understand the severity andsubtleness of the problem and go beyond democratic means to diffusethe crisis.

Minorities in J&K Should be Indentified very Carefully

A wedge has already been hammered between the majority community of Kashmir Valley and the Hindu Migrants . A more disturbing recent development has been that a local organization of Jammu has recently resented by saying that when ever a leader like PM/ President/ Sonia visited J&K only packages and programmes for Kashmiri Pundit Migrants are given priority. It has been alleged that no programme or package is announced as regards employment or relief or special assistance to the people from Jammu Region. Though this resentment is from a small group, but surely it gives damaging signals of dangers ahead to the social unity of the people of J&K. Hence resentment by the people of Jammu region alleging special treatment to Kashmir Pundit migrants at the cost of the people of Jammu Region is surely a bad development.Painfully this not the end. And a new chapter is being written to further damage the future of J&K. It has been reported that an exercise has been done by J&K Government for setting up J&K Commission for Minorities and to also notify minorities for the purpose. It has been learnt that Kashmiri Pundits are being declared as a religious minority by J&K Government along with five other religious minorities declared by GOI in 1993. The Minority Communities notified by the Government of India in October 1993 as per the provisions of the National Commission for Minorities Act 1992 include only Muslims, Sikh, Christian, Parsi and Buddhist . These are religious minorities. These have been worked out on the basis of all India level population count. Even this list is irrational since it includes Sikhs but excludes faiths like the Jains. Government of India and department of Minority Affairs Government of India have started using this list for support and benefits to five all India population basis minorities even for local matters at the level States. Even the scholarships at school level are being extended on the basis of national Level minority count. This is totally wrong and irrational.. Incase the information as received takes shape then in J&K the religious minorities would be Muslims, Sikh, Christian, Parsi , Buddhist and Kashmiri Pundits. Does it mean that Kashmiri Pundits are not HINDU ? And in case Kashmiri Pundits are to be included as a sect or segment of Hindus then there are many other sects amongst Hindu who could fall under Minority category. This way in J&K the Khajuria Pundits (Purohit Brahmins ) too could be considered for Minority Status.The Khajuria Purohits had been once accorded backward class status in J&K. Even NMC had so illogically resolved on 9.3.2000 that Kashmiri Pandits should be declared a minority community at the National level by a notification by the Central Government along with Muslims, Christians, Sikhs, Parsies and Buddists . It appears that some people have succeeded in exploiting this unfair resolve of NCM.I have been regularly summarizing my opinions on J&K . Among other things I have been opining that New Delhi does not appear to be that serious about settlement of J&K turmoil. The hurdles being posed by the constituents of UPA as well as the associates like CPM are frustrating for Shri Man Mohan Singh. Ofcourse Congress suffers of internal bickering as well. The migration of Kashmiri Pundits from the Kashmir Valley has been the severest of the blows to the monolithic structure of J&K. The two decade continuing migration also weakens the claims of Indian Government over J&K before the international community . The subject of return of Kashmiri Pundits to Kashmir Valley has been pushed deep into the ground. Through the projects like r construction of regular multistory housing colonies for Migrants at places like Jagti Nagrota the world community has been given the impressions that no possible return of Kashmiri Migrants is anticipated in the near future by GOI or the local J&K Government. Ghulam Nabi Azad Government should work seriously and refrain from pushing through more irrational proposals like declaring only Kashmiri Pundits as minority along with Muslims and Christians. J&K is already bleeding physically . Let us not bleed it socially. Otherwise. the resentment in the people of J&K will grow on some new fronts.J&K has its own Constitution . J&K must constitute a Minority Commission under its own Act and also notify the State level minorities. Such a commitment has already been made by Congress and PDP in their Common Minimum Programme . Also the Man Mohan Singh´s ( PM´s) New 15 Point Programme for minorities. The National Commission for Minorities (NCM ) in a special report made in April 1999 recommended to the Union Home Minister to accord State level minority status to the Hindus in J&K and some other States. But still in 2007-08 school level and professional level high value minority scholarships in J&K, Punjab, Nagaland, Sikkim etc have been unfairly distributed by GOI. It need be checked.
The common minimum programme for CONGRESS – PDP Coalition in J&K mentions that : - (i) all the three regions of the State have got religious minorities which face special problems (ii) J&K Government shall give full protection to the minorities and safeguard their rights (iii) a Minority Commission will be constituted in J&K . Similarly in the GUIDELINES for implementation of Prime Minister´s New 15 Point Programme for the Welfare of Minorities it is stated that :- (i) the target group of the programme consists of the eligible sections among the minorities notified under Section 2 (c) of the National Commission for Minorities Act, 1992, ( viz, Muslims, Christians, Sikhs, Buddhists and Zoroastrians (Parsis) (ii) in States, where one of the minority communities notified under Section 2 (c) of the NC for Minorities Act, 1992 is , in fact, in majority, the earmarking of physical/financial targets under different schemes will be only for the other notified minorities. Such states have been mentioned as Jammu & Kashmir, Punjab, Meghalaya, Sikkim, Mizoram , Nagaland and . Lakshadweep ( UT). It means that Christians in Mizoram , Muslims in J&K , Buddhist in Sikkim and Sikhs in Punjab should l not be covered under the targets / benefits at state level.Questions with regard to determination of a Minorities at State level / national have been raised by High Courts as well as the Supreme Court of India. .NMC in a meeting held on 9.3.2000 resolved that (i) the Kashmiri Pandits should be declared a minority community at the national level through a notification by the Central Government and (ii) the territorial jurisdiction of the NCM Act, 1992 should be extended to the State of J&K. The 3rd NCM visited J&K from 30th March to 1st April, 2000 . NMC conveyed some recommendations to the Union Government on 01.05.2000.The National Commission for Minorities Act, 1992, came into force on May 17, 1992. The NCM Act 1992 does not lay down any criteria for nominating the minorities. Sub-section (c) of Section 2 simply says that "minority" for the purposes of this Act, means a community notified as such by the Central Government. Political parties ruling at Center have tried to take un due political advantage of this discretion. Government of India notified in October 1993 the minority communities as Muslims, Sikh, Christian, Parsi and Buddhist . Even the first NCM headed by Dr.Tahir Mahmood in its first meeting itself as held on 17th December 1996 recommended for recognizing the Jain community as minority . Later Dr. Mahmood in his briefing to the media on 25-11-98 had gone on record stating (i) So far, the Government has been content with National level minorities only (ii) but NCM had come out with the concept of State-level Minorities and (iii) NMC virtually recognised Hindus as a minority under jurisdiction of NCM in the States of Jammu and Kashmir, Punjab, Meghalaya, Mizoram, Nagaland and the Union territories of Lakshadweepa and Chandigarh." Although recognizing minorities does not so far fall with in the jurisdiction of NMC under the Act still the observation should not have been ignored by GOI. for also notifying Hindu as minority region or state wise. Even minority community and religious minority are surely two different things. The 3rd National Commission for Minorities (constituted vide notification dated 21st January, 2000 ) had asked in March 2000 some State Govt./UTs who had not set up State Minorities Commission to set up Minority Commission with a statutory status. The proposals for declaring only Kashmiri Pundits as Minority if go through ,as per the reports , would be a totally irrational exercise. Declaring only the Kashmiri Pundits as a Minority community at the National level/ State level along with Muslims, Christians, Buddhists, Parsees and Sikhs would be as good as declaring that Kashmiri Pundits are not Hindu. Recreation of the Saga of atrocities on Kashmiri Pundits in Sikkim.

Just today the central goverment has announced a package to rehabilitate Pundits in Kashmir who are willing to Risk going back to what was their home for centuries while the same government is promoting policies which will create the same Pundit crucifixion scenario in Sikkim.The finance act proposes to make income tax payable in Sikkim for all those without Sikkim subject status thus depriving ethnic Indians living there for a hundred years of their legitimate rights because they have not been granted Sikkim subject status simply because of racial discrimination and bias in receiving and processing their applications.What is this Sikkim subject qualification and will it create another"Op pressed Kashmir Pundit "scenario.History.
The Sikkim subject list consisted of people who the erstwhile Chogyal recognized for the purpose of voting in the erstwhile kingdom. This list was promulgated to keep the voting restricted in a manner to help keep the Bhutia /Lepcha community, to which the Chogyal belonged, in power .This was imperative for the ruler in the face of ever increasing Nepalese immigration from both Nepal and Darjeeling district .In fact the Bhutia/Lepcha votes were given extra value to ensure that the erstwhile National Party promoted by the Chogyal retained ethnic power.The first Chief Minister L.D. Kazi of ethnic Sikkimese roots lasted only a single term and in the second election Nar Bahadur Bhandari seized power by engineering defections from the "Rising sun "party of Shri Ram Chandra Poudyal a predominantly Nepali leader and a hero of the struggle against the Chogyal's unpopular regime.In this way the Nepalese came to power for the first time but realized soon that they could never enjoy the true fruits of majority democratic power until they controlled the seats reserved for the Bhutia/ Lepcha community.In consequence a movement headed by N.B. Bhandari, the erstwhile Chief Minister, headed for New Delhi and persuaded the Central Government to give a one time waiver and include 70,000 Nepalese in the "Sikkim Subject" Register. This consisted of more than 25% of the total vote and consisted of a very selective list of people from only the Nepali community and made specifically for the purpose of retaining and promoting political power for this community. No other communities were included in this list which was based solely on racial considerations and they were given Sikkim Subject Status and the power to vote and this ensured that they even controlled by Proxy thereserved seats given by the constitution to the Bhutia /Lepcha population to help ensure their identity. As a result the Nepalese de-facto gained control of and will always control all 31 seats of 32 in the Sikkim Legislature.There were many other people from other communities like Bihari, Punjabi, Marwari, Muslim and even many Nepalis of Darjeeling origin (known as WGY) who met all and more of any criteria that were required but they were specifically not included in the list as these groups individually or collectively were perceived at that time to be a vote bloc which would1. Vote against any anti-India legislation ( which views Chief Minister, N.B. Bhandari secretly espoused with his "Return Kingdom Sikkim" political platform) and under which he initially won the elections against L.D. Kazi ,who was the supreme leader of the Revolution against the Chogyal's autocratic rule and
2. Some could possibly also vote with The Bhutia/Lepcha community to add to their numbers in a situation to reduce the brute Nepali majority which could be used to smother legitimate minority aspirations.The Second Bhandari electoral victory around 83/84 saw him come to power with a brute majority commanding 31 out of 32 MLA's in the Assembly. However, this victory was soured by the single opposition winner from cosmopolitan Gangtok, the Capital town constituency , from where Independent Balchand Sarda of Marwari decent fought and won as an Independent candidate against a very strong Mrs. Bhandari the wife of the all triumphant anti Indian Chief Minister. (Ironically the advisors of L.D. Kazi the routed ruling Chief Minister had felt that fielding Balchand could disturb Nepali sentiment and put all other contestants at risk because of a perceived Nepali ire at such a move by the ruling party.) In fact Balchand Sarda and family with a hundred years of history in Sikkim is now being deprived of Sikkimese identity and being discriminated against when people of very recent arrival into Sikkim are being given this subject status. In fact till date no political party is willing to espouse the cause of this minority community of less than 1% of the population who face a fate akin to the Kashmiri Pundits.
However, the granting of "Sikkim subject status" to individual candidates continued and still continues unabated being awarded to many applicants from the Bhutia /Lepcha and Nepali community from either Nepal or Darjeeling District who have either bought land in Sikkim or claimed imagined decent from old Sikkim resident families.In fact depending on which party was in power at the time "subject status" application of various people of different ethnic backgrounds have succeeded. Thus when a Bhutia friendly administration reigned even Tibetan Refugees have illegally been granted "status" in the bid to increase their numbers and vice versa when a Nepali friendly administration is in power all sorts of recent entrants to Sikkim have been granted this status from even Nepal. Many of these successful applicants are of very doubtful antecedents and historical veracity as both Nepalese Nationals and Tibetan refugees once officially accepted generate a very destabilizing influence in the corridors of powerbecause of their sympathies either for the erstwhile Chogyal's Regime or for a Nepalese state that they secretly desire.The minority communities not having political protection and living in an atmosphere of a heavy communal divide have continuously been decimated and discriminated against as a group -----irrespective of their history in Sikkim or their length of stay. The least protection that the Finance minister can give is to ensure that the Sikkim subject status is granted fairly to all who deserve it under open guidelines which are publicly made available and enforceable without fear or favour or a Kashmiri pundit is waiting to happen.This policy and atmosphere of blatant communalism is further expounded by the very recent blatantly unconstitutional bill in the Sikkim assembly proposing to enact a law by which all jobs in the state of Sikkim whether in the private or public sector are to be reserved for "Sikkimese" i.e. "Sikkim Subject Holders" which means that now even children of people of Sikkim who have been residing in Sikkim for over a hundred years are not eligible for jobs even in the private sector in the state. All "Indians" have historically always been barred from Government jobs and this discrimination continues to date even after 33 years of joining the Indian Union.Similarly the state has a very aggressive policy of barring even petty business ventures in Sikkim by requiring impossible conditions to be met by any new petty business applicant from outside the state. The municipal authorities working directly under the guidance of the Urban development department looks specifically at the race and origin ofapplicants before processing any applications. The erstwhile Municipal Corporation has been superseded, and not reinstated for more than 20 years, thus effectively depriving people of Indian origin (who are mostly conglomerated around towns) of any say in the democratic functioning of the state in the one place where their voice might count for a little. Even Nepalese who led the fight to defeat the Chogyal's repressive government by active participation in the movement were excluded from the Sikkim Subject status which "status" was one of the main reasons for which people risked life and limb in the movement. Today these Indian Nepalese from Darjeeling who seek opportunities are alsodiscriminated against and will one day be forced to start a movement for equality under the constitution. This will in time lead to the demand for a Nepalese state with darjeeling District seceding from Bengal and joining Sikkim to form a more viable state.In fact all sorts of constitutional immoralities are been committed in Sikkim today and it is time that the Central Authorities established the rule of the constitution without fear or favour as envisaged by the founding fathers instead of encouraging dissidence from India and all things Indian which , will if not arrested firmly, lead to another Kashmir like situation demanding separation, throwing out Legitimate Indians, just as the Kashmiri Pundits were thrown out because the central government made exactly this mistake in History by pampering a border area to create a Frankenstein.1.In this land of Bharat we are seriously disturbed when Sharad Pawar claims citizenship rights by birth for becoming Prime Minister but in Sikkim an Indian Citizen born there for three generation cannot get rights which are being given freely to first generation Nepali citizens and even Tibetan Refugees. Apart from the illegality of it this is an abhorrent insult to Indian Citizens which even the British did not inflict.
2.The Latest Frankenstein theory making the rounds of Katmandu, Gangtok and Darjeeling is of an independent Gorkha state expanding to join with the ethnically secure northern areas of Nepal as a Pure Pan Nepal state of purely Nepalese ethnicity separated from the huge ethnically impure populations of southern Nepal and Doars area which will serve as a buffer state between India and Nepal.

IN HIS EDITORIAL S.DASGUPTA IN TIMES OF INDIA DATED 19/04/2008 CASTIGATES THE MANDARINS OF SOUTH BLOCK FOR MISSING THE PROVERBIAL WOODS IN THEIR ANALYSIS OF THE NEPALESE POLITICAL SCENE PRE –THE RECENT ELECTIONS IN NEPAL.

Unfortunately the worthies of both south and north block have historically and are even today missing not only the proverbial woods but much much more in their analysis of the entire gamut of consequences that are going to result from the new neo-Nepalese movement..

The Indian trader is the van guard of our culture and ethos in any country. .He is the bravest of us risking his all in distant foreign cultures and always succeeding against the odds in guarding Indian values and thoughts in very difficult surroundings often critical and inimical to his success..

When will we learn that when we turn a blind eye to---- nay even encourage and allow---- basic anti Indian feelings, thoughts and behaviour to be articulated in every day life against our Indian traders, be they ever so lowly and vile in the eyes of the "educated" Babus of the embassies, we thereby establish the failure of Indian diplomacy right there and then and lay the foundation stone of all future Hate India campaigns that are
bound to be engineered ---because all people realize all to soon that a government which does not value and protect its best citizenry is up for sale and open to insults without repercussions..

The constant giving in by India to outrageous demands often targetted against India's basic security interests has encouraged a new sense of Nepalese chauvinism as evident not only in the Gorkha community of Nepal but more alarmingly in the Nepalese of Darjeeling and Sikkim hills .

Thus blatantly Nepal under Maoist control is demanding a revision of the Indo- Nepal treaty with Nepal insisting that all the benefits of the open border for Nepal continue while whittling down the protection given to Non-Nepalese ( read Indians) given by the treaty and south bloc ( to cover a potentially explosive situation resulting from the miss- reading of the Nepalese scene ) is now preparing to placate Prachanda by again conceding basic Indian interests as protected by the treaty of 1950.

India basely compromised on basic principals when it gave in to Bhutan by allowing eviction of Nepalese from Bhutan and as a hidden consequence it also gave up equal treatment protections for Indian required from Bhutan by treaty.. Today the government of India turns a blind eye to blatant discrimination of Indians in Bhutan and lauds itself for successful diplomacy!!


As a result the Nepalese have learned that Government of India will sacrifice basic values and policies without any thought just to buy peace for any petty problem they can engineer as they are aware that Delhi has no time for peripheral India.


As a direct consequence Nepalese chauvinism is taking directly Anti-Indian tones in its intellectual thrust and on the ground in Nepal and more importantly at home in Darjeeling ,Jalpaiguri and Sikkim the consequences are all to evident..

1. In Nepal as soon as Prachanda gets rid of the King his first political target will be to crush and destroy the very recent Madhese power base which has developed.(Madhesies are of-course hated and reviled as Indians)
However without absolute control of this populous and productive region no Government in Nepal can survive and Prachanda rightly calculates that India ever willing to buy peace when threatened will succumb when threatened by Nepalese backing the growing Moaist threat in India.. India will quickly agree to sacrifice the Madhesi cause for political and economic freedom in return for a temporary peace but India will once again gain nothing as Prachanda's threat will remain as blackmail chip against India for ever..
(Note China who would never countenance any such threats will be encouraging these activities from the sidelines.)

2. In Darjeeling Bimal Gurung has the Bengal Government by the hip and will soon have his Mini-Nepal as the Bengali Communists are ready to through in the trowel and will now allow the new state minus Siliguri which they are ridiculously protecting from even peaceful Nepalese processions by posting armed cadre at the entry points of the city.
Here to the interests of the minority Bengali, Bihari and other plains people known locally as Madhesies or "Indians" will be sacrificed to buy peace (and all important Siliguri town) from the proposed Gorkhaland State now a foregone conclusion.

3. In Sikkim the proof of all the above is already evident in black and white as

A. the government flouting all constitutional norms, requirement and safeguards has reserved 95% jobs in even the private sector for a specially created category under which the beneficiaries are the 75 % Nepalese Majority of the state . The deprived people are again the Madhesies.

B. Similarly the Government has also built up a plethora of Municipal rules specifically to prevent the Madhesi community from getting even petty trade licenses in this state. Thus even surpassing Kashmir this state is barred for Indians (Madhesies) unless they are rich Indians and have million of dollars to invest in lotteries and hydel projects which fund the political parties who work against India's interests.


C. Recently under the continuous secret haranguing of the state government the central finance bill is set to make into law provisions that will deny
Any Sikkimese women married to an "Indian" not only the political rights of her offspring but also her constitutional rights of inheritance and all this to prevent any "Indian" from gaining political rights in the projected racially pure Nepalese state.
Stopping benefits under the Income tax act to Madhesies of a hundred years history while allowing the same benefits to similarly placed Tibetans of 50 years and less ancestry and Nepalese with only 20 years ancestry.

D. I n the recent delimitation exercise in Sikkim Bureaucrats from Delhi worked at the behest of local political masters to break up three important constituencies Gangtok, Singtam and Jorethang all having substantial Madhesi (Indian) voting blocs. Each constituency was divided into two constituencies so that Madhesi political power could be whittled down to become ineffective. Ironically the Madhesies who are considered forward were in each case put into reserved scheduled caste / tribe constituencies.

It is quite evident that the bureaucrats in Delhi and their political masters are either not doing their job or are incapable of doing their job and are selling the interests of India and creating states which will ultimately prove anti-national with tendencies to blackmail the centre into further concessions ad infinitum and this is the charitable viewpoint.

The other viewpoint of the Indian Bureaucrat ready to pass any law or scheme in return for his cut is widely prevalent in the North Eastern states. Thus no N.E. state bothers with Accountant Generals or accounts which are in general woefully missing. Each State is aware that each secretary is for sale as he always wants his favourite businessman to be sanctioned each big scheme that he releases for the state and the planning commission will take its cut for the plan funds and the well paid officers of the central government are only to happy to cover up accounting deficiencies by blaming it on the backward tribal who cannot keep accounts or as necessary payment for preventing potential insurgency.

In Sikkim China is known as "Mama" and the Nepalese traditionally turn for help to their mother's brother when they find going becomes tough in their fathers house.
